Cold Guava respects the intellectual property rights of artists, designers, writers, developers, photographers, musicians, and other creators.

This Licensing & Intellectual Property Policy explains the ownership and permitted use of creative works published, distributed, displayed, developed, or commercially used by Cold Guava.

1. Bilal Sayed Creative Works

Original artwork, illustrations, designs, characters, concepts, visual assets, and other creative works created and owned by Bilal Sayed remain the intellectual property of Bilal Sayed unless expressly stated otherwise.

Bilal Sayed grants Cold Guava an exclusive commercial licence to use the Bilal Sayed works covered by the applicable licensing arrangement.

Subject to the terms of that arrangement, Cold Guava may reproduce, publish, distribute, display, market, promote, adapt, incorporate, and commercially use licensed works in connection with its products, services, publications, games, digital products, merchandise, printed products, packaging, promotional materials, websites, applications, and other approved commercial activities.

Ownership of the underlying copyright remains with Bilal Sayed unless copyright is expressly transferred through a separate written agreement.

2. Exclusivity

Where a Bilal Sayed work is licensed exclusively to Cold Guava for specified commercial uses, those licensed commercial rights are reserved for Cold Guava.

No third party may reproduce, manufacture, distribute, sell, publish, license, commercially exploit, or otherwise use such work without the appropriate written permission.

The scope of exclusivity, including applicable products, uses, territories and duration, may be further defined by the relevant written licensing agreement.

Bilal Sayed may retain rights not included within the exclusive commercial licence, including rights relating to authorship, portfolio presentation, exhibitions, archival purposes, and other uses permitted by the applicable licensing agreement.

3. Third-Party Artists & Creators

Cold Guava may collaborate with and license creative material from independent artists, illustrators, designers, photographers, musicians, writers, developers, studios, agencies, stock providers, and other rights holders.

Such material may be used under commercial, exclusive, non-exclusive, royalty-based, commissioned, or other licences obtained from the relevant rights holder.

Cold Guava's rights to third-party material are limited to the rights granted under the applicable licence or agreement.

Copyright and other intellectual property rights in third-party works remain with their respective owners unless ownership has been legally transferred to Cold Guava.

4. Commercial Licensing

Cold Guava may obtain licences permitting creative material to be used commercially in areas including:

The exact rights applicable to any work depend on the licence under which that work was obtained.

5. No Automatic Permission

The presence of artwork, graphics, characters, photographs, designs, games, publications, logos, or other creative material on a website, social-media account, application, product, or publication operated by Cold Guava does not place that material in the public domain or grant permission for others to use it.

Downloading, viewing, purchasing, or accessing a product or creative work does not transfer its intellectual property rights.

6. Prohibited Uses

Unless permission has been expressly granted by the relevant rights holder, users may not copy, reproduce, republish, redistribute, sell, sublicense, modify, commercially exploit, manufacture products from, or falsely claim ownership or authorship of protected material used by Cold Guava.

This includes using protected works for commercial merchandise, print-on-demand products, digital products, games, advertising, branding, resale, or other commercial purposes without the required permission.

7. Personal Purchases

Purchasing a product containing licensed artwork or other intellectual property gives the purchaser ownership of that particular physical or digital product only to the extent provided by its terms of sale.

A purchase does not normally grant the purchaser copyright, trademark rights, reproduction rights, merchandising rights, sublicensing rights, or other intellectual property rights in the underlying creative work.

8. Artist Credit

Where appropriate or contractually required, Cold Guava may identify and credit the artist, creator, studio, or other rights holder responsible for licensed material.

A credit does not necessarily indicate ownership by Cold Guava and does not alter the terms of the applicable licence.

9. Cold Guava Intellectual Property

Cold Guava may also own intellectual property independently of material licensed from Bilal Sayed or other creators.

This may include original publishing assets, game assets, branding, logos, product designs, written material, software, website content, layouts, marketing materials, and other works created by or legally transferred to Cold Guava.

Such material may not be used without permission except where permitted by applicable law.

10. Trademarks & Branding

Names, logos, product names, game titles, visual identities, and other brand identifiers associated with Cold Guava or Bilal Sayed may also be protected by trademark or other applicable intellectual property laws.

Nothing in this policy grants a licence to use those names or branding unless permission is expressly provided.

11. Copyright Infringement

Cold Guava takes intellectual property rights seriously.

If you believe material published or distributed by Cold Guava infringes copyright or another intellectual property right that you own or are authorised to represent, please contact Cold Guava with sufficient information to identify the work, the allegedly infringing material, and the basis of your claim.

Valid infringement concerns will be reviewed and addressed as appropriate.

12. Licensing Enquiries

Artists, creators, rights holders, businesses, publishers, manufacturers, and other organisations interested in licensing, collaboration, publishing, merchandising, or authorised use of creative works should contact Cold Guava through the official contact information provided on this website.

Any licence, collaboration, or permission is valid only to the extent established by the applicable agreement or written authorisation.

13. Reservation of Rights

All rights not expressly granted are reserved by their respective owners.

Nothing contained on this website should be interpreted as granting a licence or other intellectual property right by implication, estoppel, or otherwise where such a right has not been expressly granted.
